Terms of Use

Acceptance of Terms

By creating an account or using Scribbard (the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a binding legal agreement between you and PIGILABS LLC, a Wyoming limited liability company, operator of Scribbard ("Scribbard", "we", "us", "our"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

The Service

Scribbard is an AI-assisted novel-writing platform. It provides tools to help users plan, structure, draft, review, and export long-form fiction. The Service includes a web application, AI generation features, and associated tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Accounts

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@scribbard.com if you suspect unauthorised access to your account.

You may not share your account, sell access to your account, or allow others to use your account credentials.

Subscriptions and Plans

Scribbard offers a free plan (Typostat) and paid subscription plans (Lexigenist, Prosewright). Paid plans are billed on a monthly or annual basis through Stripe.

Plan features and pricing are described on our Pricing page. We reserve the right to change pricing with at least 30 days' notice to active subscribers. Price changes will not take effect until your next billing cycle after the notice period.

Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings or by contacting us.

Billing and Refund Policy

All subscription fees are charged in advance for the upcoming billing period and are non-refundable.

If you cancel your subscription, you will retain full access to your paid plan features until the end of your current paid billing period. Your account will then revert to the free Typostat plan. No partial refunds are issued for unused portions of a billing period.

If you believe you have been charged in error, contact us within 30 days of the charge at billing@scribbard.com. Erroneous charges will be reviewed and refunded at our discretion.

We do not offer refunds on the grounds of dissatisfaction with AI-generated output, since the quality of output depends substantially on the inputs you provide and on the inherent variability of AI systems. We encourage you to use the free plan and the free creation steps to evaluate the Service before subscribing.

Fair Use Policy

Scribbard is designed for individual writers working on their own creative projects. Your subscription entitles you to use the Service for your own personal or commercial writing within the limits of your plan. It does not entitle you to resell access to the Service, provide the Service to third parties, or use the Service as infrastructure for another product or platform.

The following uses are not permitted and may result in account suspension or termination:

  • Reselling, sublicensing, or providing access to your account to third parties
  • Using the Service to generate content at scale for commercial resale (e.g., mass-producing AI-written books for publication without substantive human creative involvement)
  • Automated or scripted use of the Service in a manner that places unreasonable load on our infrastructure
  • Creating multiple accounts to circumvent plan limits
  • Using the Service in any way that interferes with other users' access to it

We do not define "commercial use" as prohibited. You may write novels using Scribbard and publish, sell, or otherwise commercialise them. The restriction is on using Scribbard itself as a commercial service you provide to others.

We reserve the right to assess unusual usage patterns and take action where usage is inconsistent with individual personal use, including throttling, suspending, or terminating accounts that appear to be in violation of this policy.

Your Content

You retain ownership of all content you create using the Service, including your story concepts, characters, world-building details, outlines, and any prose you write or edit directly.

The ownership of AI-generated content (scenes and passages generated by the Service on your behalf) is subject to the laws of your jurisdiction and the policies of the relevant AI providers. We make no representation as to the copyright status of AI-generated output. You are responsible for reviewing generated content before publication.

By using the Service, you grant Scribbard a limited, non-exclusive licence to store, process, and transmit your content solely to the extent necessary to provide the Service to you. We do not claim any ownership rights over your content.

We do not use your content to train AI models. See our Privacy Policy for details on how your content is handled when sent to AI providers.

Intellectual Property

The Scribbard platform, including its software, design, user interface, branding, and all underlying technology, is owned by Scribbard and protected by intellectual property laws. Nothing in these Terms grants you any rights to Scribbard's intellectual property beyond the limited licence to use the Service as described here.

You may not copy, modify, distribute, sell, reverse-engineer, decompile, or create derivative works based on the Service or any part of it.

Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene
  • Generate content that sexualises minors in any way
  • Infringe the intellectual property rights of any person or entity
  • Attempt to gain unauthorised access to Scribbard's systems or another user's account
  • Transmit malware, viruses, or any other malicious code
  • Harass, impersonate, or intimidate any person
  • Violate any applicable law or regulation

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts of users who repeatedly or egregiously violate them.

AI-Generated Content

The Service uses third-party AI models to generate prose and other content. AI-generated content may be inaccurate, inconsistent, or inappropriate. You are solely responsible for reviewing all AI-generated content before use, publication, or distribution.

Scribbard does not guarantee the accuracy, quality, originality, or non-infringement of any AI-generated content. The Service is a creative drafting tool, not a legal, medical, or professional advice service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any particular result will be achieved through use of the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCRIBBARD AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SCRIBBARD IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Termination

You may close your account at any time through your account settings. Closure does not entitle you to a refund of any prepaid subscription fees.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide reasonable notice where possible, except where immediate action is required to prevent harm.

Upon termination, your right to use the Service ends. Sections of these Terms that by their nature should survive termination — including Content, Intellectual Property, Disclaimer, Limitation of Liability, and Governing Law — will survive.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, with proceedings conducted in Wyoming. You waive any right to a jury trial or to participate in a class action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by email or prominent notice on the website at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service before they take effect.
